Latest word from Attorney General Jack Conway’s office is that an opinion on whether the legislature can approve racetrack slots without a constitutional amendment will not be ready Thursday or Friday. The General Assembly convenes Monday for a special session to consider, among other things, Gov. Steve Beshear’s proposal to authorize racetrack slots by statute.

An AG opinion is worthless. How about a court decision before spending hundreds of thousands of dollars on a special session?
I wish we could have a court decision before the vote so people would accept the fact that it is constitutional to have slots at tracks when they are run by the Lottery. Unfortunately, the courts will not address the issue before it is ripe (legislation and administrative regulations have been passed).
